Responsibilities of the Wheelchair / Electric Wheelchair / Mobility Scooter Hirer (detailed as “equipment”)

1.1 The hirer must ensure that the maximum load weight of 18 stone (114kg) is not exceeded, unless a different weight limit is specified for the equipment supplied.

1.2 Any equipment defects must be reported immediately.

1.3 The equipment is to be used in a correct fashion and must not cause danger to the occupant or to others.

1.4 Punctures and puncture repairs are the responsibility of the equipment hirer.

1.5 The hirer is responsible for loss of, or damage to, the equipment during the hire period, except for fair wear and tear. Where equipment is returned damaged, lost, stolen, incomplete or beyond economical repair, Dorset Wheelchair Hire may charge the reasonable cost of repair or replacement, together with any reasonable associated costs. Replacement charges will not exceed the reasonable replacement value of the equipment, taking into account the type and condition of the equipment supplied. Current indicative replacement values are: self-propelled wheelchair up to £250.00; transit wheelchair up to £250.00; children’s wheelchair up to £250.00; bariatric wheelchair up to £250.00; mobility scooter up to £2,500.00 and Electric Wheelchairs £2,500.00. Evidence of the cost will be provided where reasonably requested.

1.6 The packaging on delivery must be retained for returning the equipment.

1.7 The equipment must be cleaned prior to return. Failure to do so will result in a deduction of £10.00 for cleaning charges.

1.8 Do not take your equipment off road. This equipment is designed for pavement use only.

1.9 Folding mobility scooters are designed for use on the flat, not hills, as hills will drain the battery quicker. The hirer must ensure they take the charger with them at all times so they can recharge if needed.

1.10 The duration of the battery charge will vary depending on terrain, weight carried, weather conditions, gradients and usage. Dorset Wheelchair Hire cannot guarantee the distance or duration that an electric wheelchair or mobility scooter will travel on a single charge.

1.11 Electric wheelchairs must be charged and used in accordance with the instructions provided. The hirer must not overcharge the battery or use a charger other than the charger supplied with the equipment. The mobility scooter hirer agrees not to charge the scooter battery for more than 6 hours.

1.12 We strongly recommend that mobility scooter hirers consider suitable breakdown cover for the hire period, particularly where the scooter will be used away from the delivery address. Unless Dorset Wheelchair Hire confirms otherwise in writing before booking, arranging breakdown cover is the hirer’s responsibility and is not included in the hire charge.

1.13 The hirer is responsible for ensuring that all accessories supplied with the equipment are returned at the end of the hire period. Loss of keys, chargers, battery locks, baskets, cushions, straps or other accessories supplied with the equipment may result in a reasonable replacement charge by Dorset Wheelchair Hire.

1.14 The hirer is responsible for ensuring that any person using the equipment is capable of operating it safely and in accordance with any instructions supplied. Dorset Wheelchair Hire reserves the right to refuse hire where it reasonably believes the equipment may be used in an unsafe manner.

1.15 Dorset Wheelchair Hire does not provide insurance for loss, theft or accidental damage to hired equipment unless expressly stated otherwise in writing.

2.0 Delivery and Collection Terms

2.1 Dorset Wheelchair Hire does not guarantee delivery at a specific time unless expressly agreed in writing. Standard deliveries are undertaken between 8:00am and 3:00pm on the agreed hire start date. If the customer is not available at the delivery address, Dorset Wheelchair Hire reserves the right to leave the equipment at the venue or delivery location in a safe and secure place. Delivery shall be deemed complete once the equipment has been left at the agreed venue, hotel, holiday park, care home or other specified delivery location at the customer's request. Responsibility for the equipment passes to the hirer upon delivery to the agreed location.

2.2 Delivery slots are not guaranteed for a specific time. Where a customer requires delivery outside Dorset Wheelchair Hire's standard delivery slot of 8:00am to 3:00pm, or requires delivery before the first day of hire, an additional day's hire charge will apply. Early delivery requests are subject to availability and must be agreed in advance by Dorset Wheelchair Hire.

2.3 Collection of the equipment on the final day of hire will take place from 10:00am onwards. Customers must ensure that the equipment is ready for collection from the original delivery point, unless an alternative collection point has been agreed in advance by Dorset Wheelchair Hire. If the equipment is not available for collection, Dorset Wheelchair Hire reserves the right to charge a reasonable additional collection fee to cover any failed or rearranged collection visit.

2.4 Dorset Wheelchair Hire shall not be liable for delays or failure to perform its obligations where such delays are caused by circumstances beyond our reasonable control, including severe weather, flooding, road closures, accidents, transport disruption, vehicle breakdown, industrial action or other unforeseen events.

2.5 If equipment is left unattended, abandoned, or not made available for collection at the agreed location, Dorset Wheelchair Hire reserves the right to recover all reasonable costs incurred in locating, collecting and returning the equipment.

3.0 Early Return of Equipment

3.1 If the hirer returns the equipment before the end of the agreed hire period, no refund will be due for the unused hire period unless Dorset Wheelchair Hire agrees otherwise in writing. This is because the equipment has been reserved for the customer for the full hire period and may not be available to hire to another customer at short notice.

4.0 Wheelchair / Electric Wheelchair / Mobility Scooter Defects (detailed as “equipment”)

4.1 If at any stage during the hiring period the equipment should be defective, the hirer is responsible for making contact. If the equipment is defective it is not to be used in any form until it has been repaired or replaced.

4.2 If the equipment has a puncture then it is the responsibility of the hirer to repair or have the puncture repaired.

4.3 If the equipment develops, or appears to have, any defect during the hire period, the hirer must stop using it immediately and contact Dorset Wheelchair Hire as soon as possible so that we can assess, repair or replace the equipment where appropriate. The hirer must not continue to use any equipment once a defect has been identified. Dorset Wheelchair Hire will not be responsible for loss, damage or injury caused by the hirer continuing to use equipment after becoming aware of a defect, or by misuse, neglect or use other than in accordance with these terms.

5.0 Cancellation by the Customer

5.1 Customers may cancel a booking within 14 calendar days of the date the booking is made, provided the hire period has not already commenced. If the customer requests that the hire commence during the 14-day cancellation period, the customer expressly requests the immediate provision of services and acknowledges that cancellation rights may end once the hire period has commenced.

5.2 If the customer cancels after the 14-day cancellation period, or where preparation, allocation, delivery arrangements or loss of hire opportunity has already been incurred, Dorset Wheelchair Hire may charge a reasonable cancellation fee. Any cancellation fee will be a genuine estimate of our direct loss, including administration, preparation of equipment, delivery or collection arrangements already made, and loss of opportunity to hire the equipment to another customer.

Unless a different charge is agreed in writing, the following cancellation charges will apply:

More than 14 days before the first day of hire: no cancellation charge.

8 to 14 days before the first day of hire: 25% of the hire charge.

3 to 7 days before the first day of hire: 50% of the hire charge.

Less than 72 hours before the first day of hire: 100% cancellation fee, reflecting Dorset Wheelchair Hire's genuine estimated losses. Where Dorset Wheelchair Hire is able to re-hire the equipment for all or part of the cancelled hire period, the cancellation charge will be reduced accordingly

5.3 Once the hire has commenced, including after delivery or collection of the equipment: no refund will be due for cancellation of the remaining hire period.

6.0 Cancellation by Us

6.1 We reserve the right not to process your order if:

· We have insufficient staff or resources to deliver the services you have ordered;

· We do not provide services to your area; or

· One or more of the services you ordered was listed at an incorrect price due to a typographical error.

If we do not process your order for the above reasons, we will notify you by email and will re-credit to your account any sum deducted by us as soon as possible, but in any event within 14 days.

7.0 If There Is a Problem with the Services

7.1 If you have any questions or complaints about the services please contact us. You can do so by emailing us with your “Booking Reference” in the subject.

We are under a legal duty to supply services that are in conformity with this contract and in accordance with the Consumer Rights Act 2015 (the Act).

7.2 Dorset Wheelchair Hire will supply equipment that is of satisfactory quality, fit for purpose and as described. If a customer believes that equipment is faulty, unsafe or not as described, Dorset Wheelchair Hire must be notified immediately so that the equipment can be inspected and, where appropriate, repaired or replaced. If replacement equipment cannot be supplied within a reasonable period, Dorset Wheelchair Hire will provide an appropriate refund for any unused hire period.

8.0 Liability

8.1 We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions. We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you, or anyone acting with your express or implied authority, does or fails to do, or due to events which are beyond our reasonable control.

8.2 Furthermore, we do not accept liability for any losses related to any business of yours including, but not limited to, lost data, lost profits, lost revenues or business interruption.

8.3 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded, nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

9.0 Disclaimer

9.1 Dorset Wheelchair Hire supplies equipment in working condition and expects the hirer to use the equipment safely, responsibly and in accordance with these terms. Dorset Wheelchair Hire will not be responsible for loss, damage or injury caused by misuse, neglect, use outside the manufacturer’s intended purpose, use after a defect has been identified, or failure to follow reasonable safety instructions. This does not affect the customer’s statutory rights or any liability which cannot legally be excluded.

9.2 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales. Any dispute arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
